In these terms, "we", "us" and "ASqware" mean the legal entity named in our privacy policy. "You" means the person or organisation using this website.

We may update these terms from time to time. The version published here is the one that applies, and the date it took effect is shown above.

Use of this website

You may read, print and share the content on this site for your own business or personal use. You may quote from it with attribution and a link back.

  • Do not republish substantial portions of our content as your own.
  • Do not use the site or its content to train a commercial model without our written permission.
  • Do not attempt to gain unauthorised access to any part of the site or its infrastructure.
  • Do not use automated tools in a way that degrades the site for other visitors.
  • Do not use anything on this site for an unlawful purpose.

Services are governed by a separate agreement

Nothing on this website is an offer capable of acceptance, and nothing here forms a contract for services. Prices, timelines and deliverables described on the site are indicative and may change.

Where we work together, that work is governed by a separate written agreement signed by both parties. If anything in that agreement conflicts with these terms, the signed agreement takes precedence.

No guarantee of results

This is the clause that matters most in our industry, so we will be direct about it.

We do not guarantee rankings, traffic, leads, revenue, or placement in any search engine or AI assistant. Search engines and advertising platforms are controlled by third parties who change their systems without notice and without consulting us. Anyone in this industry who guarantees a specific ranking is either misunderstanding how these systems work or misrepresenting it.

What we commit to is the work itself, performed to a professional standard, reported honestly, with the reasoning behind each decision available to you. Any figures, case studies or benchmarks shown on this site describe past results for particular clients in particular circumstances and are not a prediction of what you will achieve.

Third-party platforms

Our services depend on platforms we do not control, including Google, Meta, LinkedIn and various analytics and email providers. Those platforms set their own policies, change their algorithms and pricing, and may suspend or restrict accounts at their discretion.

We are not responsible for a third-party platform's decisions, outages, policy changes or account actions, though we will work with you to resolve them where we can.

Intellectual property

The content, design, code and branding of this website belong to us or to our licensors, and are protected by copyright and trade mark law.

Work produced for a client is dealt with differently: on full payment, ownership of the deliverables created specifically for you transfers to you outright — copy, designs, code, content and data. We retain ownership of our own pre-existing tools, templates and methods, and of anything we developed independently of your engagement.

Confidentiality

Information you share with us while discussing a possible engagement is treated as confidential and is not disclosed to third parties, whether or not we go on to work together. We expect the same in return for commercial information we share with you.

We do not publish client results, name a client publicly, or use a client's brand in our marketing without their written permission.

Limitation of liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.

Subject to that, we are not liable for indirect or consequential loss, loss of profit, loss of revenue, loss of anticipated savings, loss of business opportunity, or loss or corruption of data arising from your use of this website.

The content of this website is provided for general information. It does not constitute professional advice for your particular situation, and you should not act on it without taking advice appropriate to your circumstances.

Indemnity

You agree to indemnify us against claims, losses and reasonable costs arising from your misuse of this website or your breach of these terms.

Governing law and jurisdiction

The courts at Ernakulam, Kerala have exclusive jurisdiction over any dispute arising from these terms or from your use of this website.
